I have been in a debate with someone about who owns the Runaways music. I think it's Joan and Kim because they wrote most of the hits. Plus the fact that Victory Blue was not able to get the licensing rights for Edgeplay becasue Kim Fowley and Joan Jett refused to participate or let her have the licensing for the doc. There is a photo of Kim, Joan and Michael Shannon on Imdb over the holiday and I made a comment about how Joan and Kim looked chummy. Does Joan need Kim for the music rights for the film?

Hmm, that's a good question. Kim participated in Edgeplay so I would think that he would've given Vicki the permission to use their songs. But Joan didn't participate so Vicki didn't get the OK from her. I wouldn't think that this was the case, but evidence points to yes, Joan most likely needs Kim's permission to use their songs.

No he actually did not. He wanted to charge her 10,000, then 5,000 then 1,000 then free but he wanted publishing or royaltie money from her. She ended up having to trick Kim. VH1 was doing a segment about the band she asked VH1 to ask Kim questions and they gave Vicki the footage of him answering her questions. She never got a one on one interview with him for Edgeplay. Ooh, I see. I did not know that. That was really awesome of her. I'm glad she didn't have to give that ass any money.
So now my answer is I'm guessing she shouldn't need Kim since she co-wrote. I think she owns the rights.

I had this whole great post-then I lost it. Publishing is very complicated, but the film and cd are different. Vicki was denied because Joan called Peer music and told them to not license for the film. Here's something: co-owners share the legal rights to the song (assuming there is no agreement to the contrary). As joint copyright owners, each writer can separately grant permission (a license) for someone to use the song, provided that each writer shares the income with the others. Although each co-owner is entitled to receive money from the song, this doesn't mean that the two writers have to share money from the song equally. One writer may receive 30% of the income and the other may earn 70%. Each writer's share is usually based on the value of their contribution. This is a matter that is agreed on by the two writers. If the writers do not agree and the issue turns into a lawsuit, then a court will decide on the value of each writer's contribution.
